Visa Refusal Rates

It is almost impossible for an untrained individual to understand Australia migration regulations, let alone keep up with the constant in migration law.

  • Over 4,000 visas have been refused under a new regulation, Criterion 4020, based on false or misleading information or bogus documents being submitted
  • 78 % of Skilled visa applications submitted by individuals without the assistance of Registered Migration Agent are incomplete, and missing critical evidence, information and documents,
  • Resulting refusal of the visa application, and/or in significant delays in processing and approval.
  • Refusal rates of up to 20 % for student visas for the 3 months ended 30 March 2013 have been recorded for some leading countries in the Asian region.

Why Use a Registered Migration Agent

Only Registered Migration Agents can give immigration assistance in Australia.

  • Registration of Migration agents is the responsibility of Office of the Migration Agents Registration Authority (MARA)
  • MARA is appointed by the Federal Government of Australia
  • Renewal of registration with MARA is mandatory on an annual basis

 

MARA is responsible to ensure Registered Migration Agents:

  • Act professionally and in a timely manner
  • Abide by the migration agent’s Code of Conduct
  • Have appropriate insurance
  • Pass character tests (including criminal history checks).

Unregistered Migration Agents

Unregistered agents are breaking the law and penalties of up to 10 years jail can apply. Anyone who gives migration advice or assistance is also breaking the law.

Training in Migration Law

As Registered Migration agents we are required to undertake up to 2 years of University training  to understand and interpret Australia’s complicated ever changing migration laws

Continuous Professional Development (CPD):

CPD is a mandatory requirement of annual registration of Migration Agents by The Office of the Migration Agents Registration Authority (MARA) an office attached to the Department of Immigration and Border Protection (DIBP).

Regular meetings with the Department of Immigration and Border Protection (DIBP):

Through our membership of the peak body for Registered Migration Agents we are able to meet personally with senior managers of the DIBP, participate in briefing sessions about changes to law and policy and on a regular basis through our MIA representatives, to understand specific issues and or changes in interpretation of law and policy.

Membership the Migration Institute of Australia (MIA):

We are members of the MIA the peak professional association for Australian migration service providers representing over 2,200 Registered Migration Agents (RMAs) across Australia and overseas.

All MIA Members undertake a Continuing Professional Development (CPD) training program designed to promote a standard of excellence in education and services in the migration industry.

Access to Procedure Advice Manual (PAM):

Registered Migration Agents have access to PAM and it is a condition of registration.

PAM provides both policy and procedural instruction relevant to the legislation for DIBP assessors and case managers.

This is a valuable tool for understanding how the regulations are interpreted by the Department of Immigration and facilitates the ability of Registered Migration Agents to submit and argue legally successful visa applications.
